PROTECTING THE RIGHTS OF WOMENIN ARMED CONFLICTSAND WARTIME – INTERNATIONAL INSTRUMENTSAND CASE LAW OVERVIEW
Abstract
Protecting the rights of women in situations of armed conflicts and wartime, as well as after the conflict, remains a key challenge in the modern world. Armed conflicts involve vast violations of rights of women and girls, which was once again and especially gravely manifested during the ongoing war in Ukraine.
The article aims to discuss protecting the rights of women during armed conflicts with the universal instruments of international law, exacerbated by the disparate risks that women and men face. Further, based on the review of the case law of international criminal law tribunals and the International Criminal Court, the article will discuss the challenges of investigating the crimes committed against women during the armed conflict and restoring justice. Although the article largely focuses on the breaches of women’s rights in armed conflicts the article will also cover in the summary the steps that need to be taken after the end of the conflict.
