DIFFERENT STANDARDS OF JUDICIAL REVIEW. THE NATURE AND OBJECT OF THE JUDGMENT OF THE EUROPEAN COURT OF HUMAN RIGHTS
Abstract
At the outset it must be stressed that the nature and object of the judgment of the European Court of Human Rights is quite different from that of a Court of Cassation, a Conseil d’Etat, and even a Constitutional Court. I will limit myself here to mentioning
three aspects of this: the jurisdiction of the Court, the means of access to the Court and the question of its relationship to Convention standards, especially by way of interpretation.
